Guard Dog off Duty

Eedra, proprietor of Barking Mad Equity for Pet Owners, has had to go away due to prolonged and unrelenting threats to her health, accommodation and livelihood by the man (and his agents) who defrauded her of property, superannuation and business back in 2004. At least Pema can laugh about it - don't we love our dogs' lives!

Therefore, the lobbying work of Barking Mad is suspended.  Individual cases for members will be reassigned as required. Court cases will be postponed as required.

Pema is now in a temporary home and doing great work with people - still.  Soon, she wll be reunited with me!

Eedra hopes to be able to return - when the legal system gets an injection of justice, when thugs work both ways or when an advocate comes along with enough guts and authority to say ENOUGH!  Or when karma reaches the white-collar criminal.

Our most recent day in court

Bias: a personal view that has the tendency to interfere with the ability to be impartial, unprejudiced or objective. Bias is not something the general public expects from a judge - or do we?

What a fascinating day! With a full court room waiting for more than 30 minutes past the scheduled start time, a judge walking in late without so much as an apology, a judge with a 'good' reputation, but known to be 'grumpy', a judge with a strong Labor past, we were in for a day of surprises - and a good display of 'grumpy' and 'past'.

If you actually get to have your matter heard on the day it is scheduled, you're lucky (a bit like our hospitals perhaps?) So in that way we were lucky. First up was a team of 4 lawyers and barristers getting their matter adjourned until tomorrow. Took a few minutes and probably cost the clients $5000 combined. As a criminal matter, those clients legal costs may well be paid by the tax-payer!

What would YOU do with $5000? These guys charge for a full day in court, even if the entire day was spent waiting. Can we charge our doctors for the hours we wait?

We've been waiting for this day for nearly two years; since our legal assembly on Long Reef Beach back in May 2007. Without getting technical, our system of government invites and respects protests and criticism (think the Opposition). Even without a bill-of-rights, this expression is long established in case law and even statute. The Right of Peaceful Assembly by R.M. Hope QC.

Barking Mad conducts our assemblies legally - they are 'authorised' by law which means with permission of the commissioner of police. This allows us to express an opinion peacefully, without menace. However, as we've said and continue to say, Warringah has been successfully menacing with us for quite some time.

If an authorised public assembly is held in the way it was approved by the Commissioner, a person is not guilty of any offence relating to participating in an unlawful assembly . . .if done for the purpose of participation. Reference.

PS: 14-April-09 The cost-effectiveness of being a criminal. Our District Court appeal was dismissed so we're off, two years after having a dog on a beach, to the next court up.

And, what everyone has asked about this day in court: It was Judge Finnane who showed us an amazing display of judicial intelligence (or some other term that makes it ok for judges to show what 'normal people' would call bias).

After judgment and before the sentencing, for the purpose of leniency, I was explaining my extensive environmental contributions in the fields of organic waste, composting, corporate environmental management and computer recycling . But I was interrupted with the rhetorical question: HOW CAN YOU BE FOR DOGS IF YOU ARE AN ENVIRONMENTALIST - DOGS DEFECATE, DOGS BITE. And I said, we defecate too, every day if it's a good day! (And I'm not sure how you eat your steak, but I like to bite mine). We await the transcript. We point you the reader to all about dog poo...

Better for the environment to streak than use public transport?

Personally, I find this photo upsetting. Streaking is a relatively accepted and often funny way to make a point, but why get knocked down in the process? Some sports I will never understand, but the point of this entry today is that it is better (by law) to behave like this naked man (and after the Mardi Gras parade we would have hoped to see a better physique), than to take your pet on public transport.

You see, our streaker payed a $1,500 fine for his publicity and had NO CONVICTION recorded. That means, he is not a 'criminal'. Me, as Barking Mad's proprietor, risk having a conviction recorded for travelling legally on a bus, and therefore being a 'criminal' forever in the public eye.

I started Barking Mad after being defrauded in a business (in which I won in a protracted court case) and having my superannuation being taken by a bank agent passing off as a 'trustee' when he wasn't, (legal action still ongoing). I decided a dog was my best companion option after all this! But the criminal fraud charges have stalled against my perpetrator and I am now at risk of being a criminal for choosing to use public transport with pooch.

Let's make clear that's my 'public-access tested', 'approved to work with children' pooch. In other words - you can step on her, pull her tail, poke your fingers in her eyes, and she will choose to move away rather than retaliate for someones really silly action. She will also never trick you into signing over a mortgage or your super to her - yet we're criminals in waiting.

Bus Arrest

I was travelling by bus from Ryde to Sydney (CBD) at about 5pm on the 21st of February. After being in court the day before (with three members all with dogs) then being arrested after spending a lovely 5 hours socialising at an outdoor pub, I boarded the bus without drama looking forward to a quiet meal in the city before travelling back up the coast by train.

• We have official correspondence on STA letterhead advising our right to travel on Sydney and Newcastle buses and ferries with our pets, as long as they are clean and well behaved - no special ID required!

It was a nice new bus with fold up seats to make space for wheelchairs. Pema was happily sitting on the floor in this space when the Transit Police boarded for a ticket check. They told me to leave because of dog. I told them to call the depot and quoted the STA instructions to bus operators that allowed me to travel on this bus. The driver confirmed he allowed me on the bus.

The transit police we not happy. They shut down the bus, got everyone off (several folks said good luck), and got the big guns in - three NSW Police. What happened next is the stuff of horror and confirms what we hear about police treatment of youths, Aboriginals and 'people of Middle Eastern appearance' and Ms. McDonald, the 62 year old (Asian) grandmother they searched and hurt while she was waiting for a bus. They grabbed me to get me off the bus so I went to get Pema. My effort to collect my dog now made me 'resisting arrest'. Why would I resist arrest? An arrest can often result in a faster policy change than other means. Dragged, feet kicked out from under me, handcuffed, separated from my dog, etc. I am injured and under medical care. The rest of the story will be in the members area. This is a sad and senseless situation. Please read about Rosa Parks - arrested in 1955 and deemed a criminal only to be later credited by the US Congress as the mother of the modern-day Civil Rights Movement. Our Legal Right to Protest

We've had our final check-in with the NSW Police. They are the regulatory authority for the assembly we are holding; we assemble under state law, not council. Our right to assemble does not take away council's right to issue infringement notices for council's regulations. Because we are actively challenging council’s interpretation of several NSW laws, infringement notices are a possibility. Remember that Barking Mad will challenge these if issued to Barking Mad members. If you are not a member, you can sign up on the day.

We expect participants to sign in, read, understand and abide by the terms and conditions of the assembly, and wear the name badge provided at registration.

We expect good behaviour from you & your dog/s. Silly as it is, ‘earning’ back our rights to public space by demonstrating responsible behaviour (even though many of our rights were removed with doubtful due-process decades ago) may be a quicker way to regain our non-criminal status back in society than a protracted court challenge. If your pooch isn’t acting how you would like, take appropriate action such as putting it on a short lead or removing it. Be sensible, be cautious, respectful, helpful and HAVE FUN.

**Two dogs mauled, violent attack on police and two rangers still missing**. This is NOT the headline we want. The media has been known to exaggerate. Our society tolerates assaults on people by other people, crimes against property including graffiti, drunken and disorderly behaviour, littering and speeding a lot more than it tolerates one dog protecting its space against another animal – these are the facts, be they logical or not.

Our analogy to Sydney's ban of dogs on beaches is this: people exceed the posted speeds on roads in their cars, yet they don't ban all of us from driving. So why do they ban us all from the beach because some people 'exceed the speed'? It's nonsensical. Once again, we do not support Ranger Anger. From my discussions with participants over the last week, I acknowledge there is a lot of frustration at the chosen priorities of northern beaches rangers to issue notices for dog offences.

I've also heard that many people think the ban of dogs on beaches is state wide - it's not! I live one hour north and 90% of our beaches are dog beaches (some on lead, some off lead), and yes, it's an urban area. See you on Salty Dog's Day Out, until then, enjoy your companions!
